Procedures of Cross-Border insolvency cases
Explanatory Notes
1. Jurisdiction
In principle, cases concerning recognition of, and relief relating to foreign insolvency proceedings shall be placed under the exclusive jurisdiction of the Seoul Bankruptcy Court(¡×630). Meanwhile, a foreign representative may apply to the Seoul Bankruptcy Court, where the debtor has his/her place of business, his/her office or his/her domicile in the Republic of Korea(¡×631¨ç).
2. Required accompanying documents
An application for recognition shall be accompanied by(¡×631¨ç):
(a) A written statement concerning the legal basis and a summary of the overall foreign insolvency proceeding;
(b) A certificate from the foreign court affirming the existence of the foreign insolvency proceeding;
(c) A certificate from the foreign court affirming the appointment of the foreign representative;
(d) A written statement concerning the main points of the foreign insolvency proceeding, including statements of creditors, the debtor and other interested parties;
(e) A written statement concerning all other foreign insolvency proceedings over the debtor, which are known to the foreign representative.
Any document written in any foreign language shall be accompanied by a translation of document into an official language of the Republic of Korea.
3. Grounds for dismissal of recognition
In any of the following cases, the court shall dismiss an application applied for the recognition of a foreign insolvency proceeding(¡×632¨è):
(a) Where expenses determined by the court are not prepaid;
(b) Where required certificates or written statements are not submitted, or the establishment and contents of those documents are not bona fide;
(c) Where recognizing the foreign insolvency proceeding is contrary to the public policy of the Republic of Korea.
4. Provisional relief
From the time of filing an application for recognition until the application is decided upon, the Seoul Bankruptcy Court may, at the request of a foreign representative or on its own motion, grant relief as provided for in the provisions of ¡×636¨ç 1 through 3(¡×635¨ç).
5. Grounds for dismissal of relief
The court shall dismiss an application applied for relief relating to a foreign insolvency proceeding, where granting the relief is contrary to the public policy of the Republic of Korea(¡×636¨é).
6. Concurrent proceedings
When an application is filed for recognizing multiple international insolvency proceedings for the same debtor, the court shall hold a joint hearing thereon(¡×639¨ç).
When recognition is granted for multiple international insolvency proceedings for the same debtor, the court may decide on which are to be a main foreign insolvency proceeding taking into account the location of the debtor's principal place of business and measures taken to protect creditors(¡×639¨è). In this regard, the court considers the Centre of Main Interests(COMI).
7. Cooperation
The court shall cooperate with any foreign court and the representative of the foreign insolvency proceeding over the following matters(¡×641):
(a) The exchange of opinions;
(b) The management and supervision of the debtor's business and properties;
(c) The coordination of multiple proceedings;
(d) Other necessary matters.
8. Hotchpot rule
Where a domestic insolvency proceeding, foreign insolvency proceedings or multiple foreign insolvency proceedings for the same debtor are in progress, any creditor who has received partial payment in respect of its claim in a foreign insolvency proceeding or overseas properties may not receive a payment for the same claim in a domestic insolvency proceeding regarding the same debtor, so long as the payment to the other creditors of the same class is proportionately less than the payment the creditor has already received(¡×642).
