Procedures of Cooperation & Coordination
Request from Domestic Insolvency Practitioner: Inquiry from -Insolvency Practitioner(Trustee, Administrator, etc.) of domestic proceedings, Judges (in charge of the proceedings) determine whether or not to proceed cooperation & coordination, Judges in charge ask for cooperation & coordination process to CBCC Judge, if necessary, Request for cooperation from CBCC judge to Foreign Court, Communicate with Foreign Court on specific procedures of cooperation
Notify the Judges in charge of confirmed procedures of cooperation, Arrange and finalize how to cooperate with Foreign Court, Judges in charge proceed to cooperate by the confirmed procedures
Request from Foreign court or Foreign representative: Inquiry on domestic insolvency proceedings from -Foreign court -Foreign representative, CBCC Judge reviews the inquiry and checks related issues, Reply to Foreign court or Foreign representative on Confirmation of receiving inquiry, CBCC Judge assign the inquiry to the judges in charge of the proceedings, Judges in charge examine how to handle the inquiry (including whether or not to proceed cooperation & coordination), CBCC Judge is reported from the judges in charge on how to deal with the inquiry, ¨çGeneral inquiry: Reply to Foreign court or Foreign representative on processing plan of the inquiry (Official Form) or ¨èRequest for Cooperation: Communicate with Foreign Court or Foreign representative on specific procedures of cooperation, Notify the Judges in charge of confirmed procedures of cooperation, Arrange and finalize how to cooperate with Foreign Court or Foreign representative, Judges in charge proceed to cooperate by the confirmed procedures
Explanatory Notes
1. It is necessary for the court to cooperate with foreign court or foreign representative for smooth and fair process between domestic insolvency proceedings and foreign insolvency proceedings(¡×641), and the Seoul Bankruptcy Court established a local rule regarding¡¸Cooperation between courts in Cross-Border Insolvency Matters(No. 504)¡¹for the cooperation.
2. Cross-Border Cooperation and Coordination Judge (hereinafter "CBCC Judge") performs a role of arranging proceedings in procedural aspects, to help judges in charge or domestic insolvency practitioner (Trustee, Administrator, etc.) cooperate with foreign court or foreign representative.
3. The CBCC Judge takes a role of arranging proceedings, not only are there requests from domestic insolvency practitioners but also requests from foreign court or foreign representative.
4. Cooperation and Coordination process shown above can apply equally to situations where foreign courts recognize domestic insolvency proceedings as foreign proceedings and grant reliefs relating to the domestic proceedings(so called the "Outbound case") and vice versa(so called the "Inbound case").
