Explanatory Notes
1. It is necessary for the court to cooperate with foreign court or foreign representative for smooth and fair process between domestic insolvency proceedings and foreign insolvency proceedings(§641), and the Seoul Bankruptcy Court established a local rule regarding「Cooperation between courts in Cross-Border Insolvency Matters(No. 504)」for the cooperation.
2. Cross-Border Cooperation and Coordination Judge (hereinafter "CBCC Judge") performs a role of arranging proceedings in procedural aspects, to help judges in charge or domestic insolvency practitioner (Trustee, Administrator, etc.) cooperate with foreign court or foreign representative.
3. The CBCC Judge takes a role of arranging proceedings, not only are there requests from domestic insolvency practitioners but also requests from foreign court or foreign representative.
4. Cooperation and Coordination process shown above can apply equally to situations where foreign courts recognize domestic insolvency proceedings as foreign proceedings and grant reliefs relating to the domestic proceedings(so called the "Outbound case") and vice versa(so called the "Inbound case").

1. 법원은 국내도산절차와 외국도산절차 간의 원활하고 공정한 진행을 위하여 외국법원 또는 외국도산절차의 대표자와 공조할 필요가 있고(법 제641조), 이를 위하여 서울회생법원은「국제도산 사건에서의 법원 간 공조」에 관한 준칙(제504호)을 신설하였습니다.
2. 국제도산 공조 및 조정 전담 법관(이하 '공조전담법관')은 국내도산절차를 담당하는 법관들 내지 도산관리인(파산관재인, 관리인 등)이 외국법원 내지 외국도산절차의 대표자와 원활하게 공조할 수 있도록 절차적인 측면에서의 조정을 합니다.
3. 공조전담법관은 국내도산절차의 관리인이 공조를 요청하는 경우뿐만 아니라 외국법원 내지 외국도산절차의 대표자가 공조를 요청하여 오는 경우에도 국내도산절차와 외국도산절차의 조정을 꾀하는 역할을 합니다.
4. 위에서 설명된 공조 및 조정 절차는 외국법원이 국내도산절차를 승인하고 지원한 경우(이른바“아웃바운드형 사건”)와 그 반대의 경우(즉, “인바운드형 사건")에 동일하게 적용될 수 있습니다.
