Memorandum of Understanding with the U.S. Bankruptcy Court for the Southern District of New York
The Seoul Bankruptcy Court and the U.S. Bankruptcy Court for the Southern District of New York, having each adopted cross-border insolvency laws based on the model law drafted by the United Nations Commission of International Trade Law, have executed a Memorandum of Understanding on the 23rd day of April, 2018. Memorandum of Understanding with the Supreme Court of Singapore
The Seoul Bankruptcy Court and the Supreme Court of Singapore, having each adopted cross-border insolvency laws based on the model law drafted by the United Nations Commission of International Trade Law, have executed a Memorandum of Understanding on the 16th day of May, 2018. Adoption of the JIN Guidelines
The Seoul Bankruptcy Court adopted the Guidelines for Communication and Cooperation Between Courts in Cross-Border Insolvency Matters drafted by the Judicial Insolvency Network(JIN) on the 28th day of June, 2018, and included it in the local practice rule. 서울회생법원은 2018. 6. 28. 사법도산네트워크(JIN)가 창안한 “국제 도산 사건에서 법원 간 교신 및 공조에 관한 가이드라인”을 채택하고, 이를 실무준칙에 반영하였다. 위 가이드라인의 PDF파일은 이곳에서 열어볼 수 있다.
Adoption of the Modalities of Court-to-Court Communication
The Seoul Bankruptcy Court adopted the Modalities of Court-to-Court Communication published by the Judicial Insolvency Network(JIN) on the 25th day of July, 2019, and included it in the local practice rule. In this regard, Cross-Border Cooperation and Coordination Judge(CBCC Judge) performs the role of Facilitator under the Modalities, and initial communications may be made in English.
